Paternity Actions in Montana

In Montana, the law presumes that a child born during the marriage is the biological child of the husband. When the parents are not sure whether the husband is the father of the child, the parties may want to separately establish paternity.

If the parents of the child are not married, and one of the parties questions the paternity, the issue of establishing paternity must be resolved before entering into a parenting plan. 

Under M.C.A. ß 40-6-105, paternity can be established by a court or administrative judgment, decree, or order. An experienced family law attorney can help you establish paternity and deal with issues of child support and establishing a parenting plan.

After a final parenting plan is established, the parties will determine the amount of child support to be paid in compliance with the requirements of M.C.A. ß 40-4-204. The amount of child support to be paid by one parent to another is based on Montana's child support guidelines.

  • The standard of living the child would have had if the parents were still together; and
  • The child's emotional, educational, and medical needs.
